Amaravati, February 22, 2026: The Andhra Pradesh High Court has reinforced that courts should give greater weight to the wife's convenience over the husband's hardship when deciding transfer requests in matrimonial disputes.
Justice Venuthurumalli Gopala Krishna Rao granted transfers in two separate cases. In one, a wife from Ongole successfully moved her husband's divorce petition from Repalle to Ongole, highlighting travel difficulties and her responsibilities for two children.
The husband opposed, claiming delays, but the court found her plea justified. A similar outcome applied in another case involving a wife in Adoni.
The court stressed examining both parties' social, economic backgrounds, and living conditions. It noted that wives often face greater barriers to travel in such matters under India's socio-economic context.
